28   Procedure for considering applications




    28 Procedure for considering applications

  (1)  Each authority must promptly consider an application for an annual
practising certificate that the Registrar submits to the
authority.

  (2)  If the authority proposes to decline an application for an annual
practising certificate, or to include or vary conditions in the health
practitioner's scope of practice, it must give the applicant---

      (a)  a notice containing enough particulars to inform the applicant
clearly of the substance of the grounds on which the authority proposes to
decline the
application, or to include or vary any conditions; and

      (b)  a copy of any information on which the authority relies in proposing
to decline the application, or to include or vary any conditions; and

      (c)  a reasonable opportunity to make written submissions and be heard,
either personally or by his or her representative, in respect of the
application.

  (3)  Subsection (2)(b) is subject to section 154.
