    70 No action to be taken while matter under investigation by Health and
Disability Commissioner

  (1)  When, in accordance with section 64, an authority notifies the Health
and Disability Commissioner of a complaint or, in accordance with section 66,
the
Health and Disability Commissioner notifies an authority of an investigation,
the authority may not take any action under this Part concerning the complaint
or the subject matter of the investigation until---

      (a)  the Health and Disability Commissioner notifies the authority---

          (i)     that the matter is not to be investigated, or investigated
further, under the Health and Disability Commissioner Act 1994; or

          (ii)    that the complaint or matter has been resolved; or

          (iii)   that the matter is not to be referred to the Director of
Proceedings under
section 45(2)(f) of that Act; or

      (b)  the Director of Proceedings notifies the authority of his or her
decision under section 49 of that Act not to institute disciplinary proceedings
in
relation to the matter.

  (2)  This section is subject to section 69.
