77   Powers to call for information or documents




    77 Powers to call for information or documents

  (1)  If the conditions stated in subsection (2) are satisfied, a professional
conduct committee may, by notice in writing, require any person to
produce to the committee any papers, documents, records, or things.

  (2)  The conditions referred to in subsection (1) are that---

      (a)  the members of the committee believe, on reasonable grounds, that
the exercise of the powers conferred by that subsection is necessary to enable
the
committee to carry out its investigation; and

      (b)  the person to whom a notice under that subsection is to be given has
failed to comply with a previous request to produce to the committee, within a
reasonable time, the papers, documents, records, or things required by the
notice; and

      (c)  the members of the committee believe, on reasonable grounds, that---

          (i)     it is not reasonably practicable to obtain the information
required by the committee from another source; or

          (ii)    for the purposes of the investigation, it is necessary to
obtain the papers, documents, records, or things to verify or refute
information obtained from another source.
