General Provisions
13   Fitness for registration



   13. Fitness for registration---No person shall be registered under
 this Act if---
   (a) He or she does not satisfy the Council that he or she has a
         reasonable ability to communicate effectively in English; or
   (b) He or she has been convicted by any court in New Zealand or
         elsewhere of any offence punishable by imprisonment for a term
         of 3 months or longer, and he or she does not satisfy the
         Council that the offence does not reflect adversely on his or
         her fitness to practise medicine; or
   (c) The Council is satisfied that the person is not fit to practise
         medicine by reason of any mental or physical condition; or
   (d) Either---
           (i) He or she is the subject of professional disciplinary
         proceedings in New Zealand or in another country; or
           (ii) He or she is under investigation, in New Zealand or in
         another country, in respect of any matter that may be the
         subject of professional disciplinary proceedings,---
           and he or she does not satisfy the Council that those
         proceedings or, as the case may be, that investigation does not
         reflect adversely on his or her fitness to practise medicine; or

   (e) He or she---
           (i) Is subject to an order of the Tribunal or the Council or
         of a medical organisation, medical disciplinary tribunal, or
         similar tribunal in another country; and
           (ii) Does not satisfy the Council that that order does not
         reflect adversely on his or her fitness to practise medicine; or

   (f) He or she does not satisfy the Council that he or she has adequate
         skill and knowledge to practise medicine; or
   (g) The Council is otherwise satisfied that the person is not fit to
         practise medicine.
