79   Interim suspension of registration in cases of suspected condition affecting fitness to practise



   79. Interim suspension of registration in cases of suspected condition
 affecting fitness to practise---(1) Where,---
   (a) The president of the Council (whether or not as a result of a
         notice forwarded to him or her under section 78 of this Act)
         considers that any medical practitioner may not be fit to
         practise medicine because of some mental or physical condition;
         and
   (b) After consulting with 2 other members of the Council (of whom 1
         must be a medical practitioner), the president is satisfied that
         it is necessary or desirable to do so, having regard to the need
         to protect the health or safety of members of the public,---
 the president may order that the registration of the practitioner be
 suspended for a period of not more than 10 working days from the date a
 copy of the order is given to the practitioner under subsection (4) of
 this section.

   (2) The president shall not be obliged to give any notice to a medical
 practitioner that the president intends to make an order under this
 section.

   (3) Every order made under this section shall---
   (a) Be in writing; and
   (b) Contain a statement of the reasons on which it is based; and
   (c) Be signed by the president or deputy president of the Council.

   (4) The Registrar shall ensure that a copy of any order made under
 this section is given to the medical practitioner concerned forthwith
 after it is made.
