87   Referral of complaints and notices of conviction to complaints assessment committee



   87. Referral of complaints and notices of conviction to complaints
 assessment committee---(1) Subject to section 86 of this Act and to
 section 39 of the Health and Disability Commissioner Act 1994, where a
 complaint is notified to the president---
   (a) By the Registrar in accordance with section 83 (4) of this Act; or

   (b) Pursuant to section 84 of this Act by the Health and Disability
         Commissioner,---
 the president shall, as soon as reasonably practicable after receiving
 the notification, refer the complaint to a complaints assessment
 committee, unless the president and the Health and Disability
 Commissioner agree that the complaint should not be so referred.

   (2) Where a notice of conviction is given under section 85 of this Act
 to the president, the president shall, as soon as reasonably practicable
 after receiving the notice, refer the notice to a complaints assessment
 committee.
